South Africa's Supreme Court of Appeal ruled that the lower court did not correctly apply the rule of dolus eventualis - whether Pistorius knew that a death would be a likely result of his actions.
Reading the ruling reached by a panel of judges, Justice Lorimer Leach said that having armed himself with a high-calibre weapon, Pistorius must have foreseen that whoever was behind the door might die.
Pistorius' lawyer argued that he believed that there was an intruder in the house but the judge said that the identity of the person behind the door was irrelevant.

After watching the trial and gobsmacked at Masipa's findings, I am more than ever convinced he knew it was her in the toilet, I think if the prosecution had the funds, they could have proven DD. I'm happy that it's now been changed to DE, at least some justice for Reeva and her family.
Ha! Take that Oscar, now you will really need that sick bucket when you realise you can't get away with murder

Sentencing set for April 18th. Pistorious to appeal. It's thought this will drag on for months. It seems that the appeal is a last resort for him and could only succeed if it can be demonstrated that the appeal judges violated his constitutional rights. Out on bail though still under house arrest.

If he does succeed with this appeal and gets off scot free can you imagine any woman ever wanting to date him. . They'd have to wear a kevlar vest and helmet at all times
I think the whole thing is a travesty !! South African justice needs a darn good shake up IMO !!

Breaking news:
South African athlete Oscar Pistorius has been denied leave to appeal against his conviction for murdering his girlfriend Reeva Steenkamp.
The Constitutional Court has made the ruling, meaning Pistorius will now be sentenced in April.
South Africa's National Prosecuting Authority (NPA) said the Constitutional Court found "no prospect of success" in Pistorius' appeal.
The case will now go back to Judge Thokozile Masipa - who cleared the athlete of murder in the original case - for sentencing on 18 April.
Prosecutors are believed to be targeting a sentence of at least 15 years in jail for Pistorius.

That sentence is too lenient seeing as he only has to serve half before qualifying for parole

Yep, hospital again. Broke my hip but now home after 4 weeks inside. Will mostly read and save my poison arrow when needed!
He got away with murder even after this appeal. 6 yrs will end up with 1 year because of previous time in clink. He needs more time in hospital I reckon.

Sorry to hear you've been poorly again But hope you are truly on the mend now As for Pistorious .....there are not enough grrrrrrrrrs available to describe my feelings of the sentence
