@GerrieNel_Not : Is your name #Oscar.#OscarPistorious : I don't remember M'Lady.
on a quick break...only 5% of SA's have guns...so not that high considering the crime rate in some area's. I'm assuming USA would have a much bigger percentage.
What little I have been able to watch is just confirmation of what I already knew...the guy is a complete and utter t*ss pot and a proven liar, still not convinced he deliberately shot Reeva...but now its more believable he could have...he seems to think he's above the law frankly!

Nel certainly seems in my estimation (Yogi will disagree) to be showing that not only is he lying about certain aspects but that he's been coached to give answers but when he deviates from the script, he says he can't remember - I think this is why people were laughing in court - because it's just farcical to keep defaulting to the I can't remember when you don't want to give the real answer

Interesting - so you reckon Nel is doing a good job Pengy?

personally yes - he's got him well and truly rattled and yet today he's got velvet gloves on - don't know if he's toned it down because he got a reprimand yesterday but he's chipping away slowly at OPs story and getting him to either admit stuff or state the I can't remember statement which could be construed as I don't want to give you the real answer as it will implicate me
it's a long drawn out cross but each bit is chip chip chip and I think showing OP to be a liar
kids are a film Pengy...I hope the links go up on youtube early and I'll watch session 2 and three after tea...makes me wonder if he could have killed her now. I agree Nels's doing a fabulous job and not even raising his voice or *pittingit tu him* unlike Roux who tried to convince witnesses that this happened and that happened...double tap for instance!

Ta Pengy Ohhh sounds like a battle of wills going on?
Enjoying reading the analysis here, yours included. I can't be doing with watching the actual trial.

I do sometimes wonder if she was just in the wrong place at the wrong time - there are times when I just about believe he thought there were burglars - I'm 100% this was the case irrespective of it being Reeva in the bathroom, I think he would have shot to kill whoever was in that bathroom and that to me is why I think this is a CH case

the double tap that Barry was wrong to have posited because OP never told him it was double tap doof doof doof doof
so he didn't hear Reeva get out of bed because the fans were blowing in his face the duvet wasn't on the floor, he knew the jeans were there because he'd seen them earlier but Nel said his earlier statement refutes this
so we're having spats about Afrikaans translations and Oldwage is told off for whispering instead of objecting
so Nel says the fans would have blocked OPs access to the balcony - in order for it to be as that photo shows, the fan would have had to be moved by a police officer, then moved back again
Nel is really enjoying himself he's just got OP to concede another discrepancy about the fan being moved and Nel doesn't believe the curtains were drawn.
circumstantial evidence is evidence Nel says : That door was open when you and the deceased got into an argument. Roux objects about argument
Ahhh so the second fan in between the big fan is missing from the photo - I hadn't noticed that either
hmmmmm
There's a lot of fan(ying) around

Hi Pengy
Hows you today?
Really enjoying reading your summaries of the days testimony, thanks everyone!
Hi Roxan fascinating isn't it
it's very similar to our manslaughter and the most he could get is 15 years
It's been classifed as: unlawful killing which is not classified as murder due to the evil intention of killing being absent. It is a term that is used in Scottish law and amongst several places and countries where the English Common Law system of Justice is administered. It is equitable to the term manslaughter.
It has two broad categories voluntary and involuntary culpable homicide. A culpable homicide is thus classified on the basis of the "mens rea" being present or not. The Latin term "mens rea" translates to "guilty mind" and is one of the basic principles used in Criminal Law. It comes from the Latin phrase that goes "actus non facit reum nisi mens sit rea" which means "the act will not make a person guilty unless the mind is also guilty".
so although he may not have wanted to murder Reeva per se, by grabbing the gun and shooting, in his mind his intent was to kill therefore culpable homicide
if that makes any sense

It makes perfect sense to me.
I managed to listen to some of the trial this morning, as I took my ipad around the house while I did the housework. Then, while I was "sofa waiting", my son called and reminded me they had Sky and I could watch the trial on their TV.
I agree that Nel gained some ground today, but OMG does that man irritate me!
I'm going to read back, so there might be a bit of spamming going on as I reply to posts.
I didn't realise that OPs father Henke hasn't been at this trial at all although he was at the bail application.
so why would you hold a relative's ammo if you hadn't spoken to them for years?
I believe Oscar and his dad have had an on/off relationship and I don't think he played a big part in Oscar's life. However, although they weren't particularly close, there was some contact prior to and after Reeva's death. Daddy Pistorius is a bit of a loose cannon and made a non PC statement in the media regarding crime and having to defend yourself, which didn't go down well with the family ( and presumably the defence team) so I think he is out in the cold, which might explain why he wouldn't make a statement about the ammunition.
I agree Yogi, he does my head in as well and I wish he would stop messing with his glasses
Gerrie is definitely painting a portrait of OP as a man obsessed with guns so much so that he carries one absolutely every where and always one up
He did seem to have an extreme fear of crime.

He drives me nuts.
Judge Masipa not happy with Nel laughing and rightly being ticked off and the gallery being reminded this is not entertainment
I think Nel rubbed up Judgy the wrong way on a couple of occasions today.
If there were burgulars locked in the bahroom - why not ring the Police and then wait with your gun cocked at the ready if need be?
Just a thought. He seems to be an angry man - whether the anger was directed at his girlfriend or potential intruders - you just don't fire like a mad man with the intent to injure or possibly kill do you?
that's exactly what I feel Soozy and why I feel he's guilty of CH but not premeditated murder - he seems to have perceived danger all around him every second of the day
I agree.

Yogi does not disagree. It crossed my mind yesterday that when Nel deviates from the questions the defence had anticipated, then Oscar falters.

Hi Pengy.
So, Reeva, in the pitch black dark bedroom, got up, walked past Oscar to the bathroom, didn't say anything to him, went into the bathroom, turning on the bathroom light and shutting the door, and Pistolrius didn't hear a thing? yeah right.
I'm past believing a thing that comes out of his mouth to be honest, I fear we'll never know...I do know one thing, he will do or say anything to not take any responsibility for any of his actions.
Iv'e only been following it on the news,he's as guilty as fook! Nasty ,psychopath.

Hi Katty Nasty , angry , self obsessed guy
But, if it is, it's not my fault, I didn't choose my name
But, if it is, it's not my fault, I didn't choose my name
Well quite. Nothing is ever his fault.
I'm not sure that the open court is going to produce a fair verdict though.
