Nel explaining that its up to the court to look at sentence, up to correctional services to accomodate inmate MV

Nel: if we have a correctional service that can't cater for him, we come back...but Modise made it clear they can cater for him.

Nel on Roux's Ubuntu argument: that's not a principle that can be considered in this case. It is too serious

Nel: on Ubuntu and restorative justice, it may be a tool in reconciling victims and perpetrator in small cases.

ubuntu deals with small cases - this is not small it's serious so society demands imprisonment

FM

10 years is the minimum Nel wants - 15 years minus 5 suspended so 10 as a minimum

31s31 seconds ago

Nel concludes. Roux has five corrections. First one about the shower.

Nel recommends that the judge sentence Pistorius to 15 years in prison with five suspended.

so a perching stool stops the necessity for grab rails

On video of reconstruction - it was done to assist the court, it was sold to media in contravention of our agreement, Roux says

Roux addresses the "blood money" - just look at the Steenkamp press release, it was Pistorius offering money left, right and centre.

Roux says The Evidence Room video leak had nothing to do with them, sold against their wishes and breaking confidentiality clause.

Roux says Oscar's shower has a pedestal in it. Says video re-enactment was sold to media, not released by legal team.

Roux says it wasn't a 'small case' that he cited in argument for restorative approach, it was a murder

Roux is done MV

Nel says he just wants to address something about the shower/bench/railing issue MV

Nel jumps back onto his feet wanting to address the shower issue. 'If you can get by with a bench, can be arranged'.

Nel says a bench can be taken into any jail shower

Masipa says she is "very impressed" with the way Nel and Roux assisted the court. "We will reconvene on Tuesday next week at 9.30."

Reconvene on Tuesday Oct 21 for actual sentencing. 0930

Seemingly not tho. . So OP will walk 'free' on Tuesday now?

I live in hope that Masipa will have been stung by the criticisms of her judgement of him and will indeed give a custodial sentence exceeding 3 years - he does not deserve to toddle off twice a month to do a few hours cleaning for killing some one then return to UA posh comfortable house

Nel can't let go of the murder conviction he failed to secure, telling Judge actions "border" on lowest murder charge.

bringing up the fact that OP said shooting a warning shot into a shower would have ricocheted into me and hurt me - Judgy didn't' take this into account - if OP recognised it could hit him - how much more would a reasonable person realise the inevitability of how 4 shots into a toilet would cause harm

I'm not sure that being critical of the judge will help get him the sentence he's after for OP.

I agree Yogi but I think he like a lot of other people feel she's already made up her mind so it doesn't matter what he says, she'll ignore it any way but I do think it's a bit childish although I understand his reasons

Nel sarcastically refers to OP as suggesting how could have earned millions and now he can't so court must feel sorry for him.

Nel: The defence is saying he should go home, stay in a luxurious house, not leave unless he wants to go training, to church, see a doctor.

bet Dame will start learning golf now she knows Gerrie plays it

too late...I have a keen interest in golf makes it all the better though

I totally agree that her mind was made up before the sentencing arguments began, and I understand Nel was frustrated at the verdict but I feel that little digs at the judge/judgement is neither professional nor helpful.

thanks Pengy, you are a star and thanks for the texts too ...all I wanted to do was head home and switch the TV on

I felt the excuses for a non custodial sentence were piss poor for want of any better words. I cheered most of what Nel said and I haven't had chance to watch it all, I thought Nel was extremely emotional at the beginning.... determination for justice instead of a pay cheque defence any time. If nothing else he's broke (still don't believe it) and hopefully a jail term to come

Failing that if she is all for the soft option and no imprisonment she should give him a bit of what I've just been thru as a slap on the wrist. .

Had an abscessed tooth extraction today, and despite being loaded up with injections, the minute he tried to pull it out it was so bluddy painful I screamed and writhed involuntarily in the chair. .was never so embarrassed in my life, but have never had so much pain in a tooth extraction as I had today.. two more rounds of injections before the pain was at a point where I could bear it while he tugged to get the tooth out..

Now OP, lets see you do Marathon man and see if you scream like a girly as I did today

There I was anxious as eck all morning cos of the trapped feelings I get in the chair and my agoraphobia making me want to leg it home but I should have been stressed about the actual treatment this time

Pengy, you have been awesome over the course of the trial. Thank you so much for your determination covering it for me, a techy ignoramous. I've loved penguinini's [sp?] contributions to Twitter, especially as I'm not on Twitter!

Dame and Yogs have been great contributors too. I know me and Rog who drop in and comment have soaked it all up and its been lovely to know that Olly and others have also enjoyed the banter here too. So on behalf of us readers of the thread, well done us!

Hopefully we can really let rip after Tuesday though!

I do hope we can maybe find another topical issue or legal event that we could discuss in the same way.

Blimey Yogi that sounds awful

I have had a few teeth extracted before and not a one of them hurt at all, and I wasn't worried about the extraction only stressed and anxious about being trapped in the chair for too long cos of my agoraphobia.. never hurt before, not even the one where the guy had his knee on my chest almost as he tugged to pulled the thing out, splintering parts of my jaw in the process.

No idea why this one was so darn painful and am so embarrassed that I actually screamed out and the waiting room was apcked when I came out too..

the abscess is still sat there under my cheek bone so am hoping it drains away before the hole heals. .am bloomin shattered today and look like I've done a few rounds with Tyson

sounds awful Olly you're not run down or have a cold? Sometimes when our immune systems are down, the pain increases and it takes longer to heal - hope it drains soon
