I've just watched it 3 times to make sure I'm seeing what I'm seeing but immediately after he hands over the note he looks towards Derman and very subtly shakes his head - to me, it looks like he's telling Derman to shut up and not proceed with what he's saying which surely must be interference with a witness?

it was all over parts of twitter on Friday morning and DS too...I truly am hoping Nel does know about it, there was talk of emailing Nel over on DS, apparently its been done before

We the jury of Gaga would just like to bring to your attenshun an incident that happened in court on Thursday 3rd of July 2014 when you had your back to the accused during cross examination of the witness Dr Wayne Derman. Mr Pistorious was seen to hand a note to one of the defence team [we watched this on the Sky News footage via youtube, timestamped at 2 hours 31 minutes of a 5 hour footage] after this he turned to the witness and very subtly shook his head. From our position, it appeared Mr P was instructing Dr Derman to discontinue with his answers in their form at that time.

 

We bring this to your attention as we are seriously concerned that this constitutes interference with the witness [knobbling as we say here in the UK] and believe that the witness testimony is therefore tainted.

 

Could you bring this to the Courts attention, in particular the gracious M'lady Judge Masipa to apply the proper sanctions.

I disagree - if he was disagreeing with the testimony then I'd have expected him to emphatically shake his head and facial expressions to be different - nothing will convince me it wasn't an attempt to shut Derman up from what he was saying

nothing will convince me either Pengy, I only hope Nel's picked up on it. Others have said he's never behaved like this before, he makes it known when he disagree's with testimony...Like his WTF is he saying, when I think it was Woolie testifying.

Personally I don't see how they could get a thorough assessment of him - he needed to be in there 24/7 in order for that to happen - his guard would have been let down at some stage
