Point is you can't be in multiple modes to one startle. Once he leaves the freeze mode to the first startle, he can't now rely on fight mode

Nel: Where would be the latest for the response to have effect? Derman: "I can't make head or tail of that question

to be fair, Nel does have a habit of putting statements rather than questions - again a tactic to confuse the witness but it could backfire as this witness won't play ball and is appealing to M'lady who seems to be taking his side

she is now telling him to answer properly

Is it not illegal too?

not sure, perjury is and I don't think it goes that far.

its proving it...all the defence witnesses reports have been made when one report was shot down, then they would bring another expert in Moons

Going round in a circle then

isn't that part of the problem - these 'experts' are expert in things they are not testifying to and out of their remit

Sounds like an 'expert assessment' to me Pengy

probably heavily coached that way so Roux/Oldfart don't have to object - they seem prepared to give this lamb to the pitbull on a plate

do you know what the three startles were Pengy..The window, the magazine rack and the door opening, is that it? I thought the magazine rack was the same noise as the supposed door opening

and I think Oldfart is ignorant..he always refers to Nel as Nel..not very gentlemanly like in a courtroom

If there wasn't a second startle, OP would have acted outside domain of flight/fight response? Derman: Not in position to know

doesn't this fall within what he's already testified to?

tunnel vision and only prepared to accept his own conclusion

I'm furious about it Sezit as a disabled person - not all the problems he stated could be attributed to OP - he's used a scattergun approach and covered all bases but to me, it just confuses things

I found a lot of his testimony quite offensive and patronising to disabled people
