Point is you can't be in multiple modes to one startle. Once he leaves the freeze mode to the first startle, he can't now rely on fight mode

to be fair, Nel does have a habit of putting statements rather than questions - again a tactic to confuse the witness but it could backfire as this witness won't play ball and is appealing to M'lady who seems to be taking his side
