Apparently the judge can lower the charge in South African courts by what I have been reading Yogi, its still a crime to kill a burglar if you are not under threat. I do think either way he should not be let off likely but fear he will. 

 

I can't also accept he was that terrified, he had left the patio doors open to sleep...he got up to close them and bring the fans in just before the shooting, so that doesn't really wash with me he was that terrified or surely he would make sure his bedroom was secure before he went to sleep.

I think this witness is covering his own a&se, elements of truth and making sure he doesn't take any responsibility of being reckless with guns 

who in their right minds takes a gun to a restaurant?  then passes it to an eejit (it's one up don't forget) and then it gets discharged and the entire restaurant thinks it's something to do with the kitchen and carry on munching

So, you can be tried and found not guilty of murder, but then the judge can introduce a lower charge and find you guilty of that? 

 

I found it strange that there seemed to be a heightened perception of burglary within the community where Oscar lived and yet so many of the witnesses mentioned sleeping with the doors to the balcony/windows left open. Maybe the oppressive heat overrides the safety issue, and of course, having a gun (which so many of them seem to have) may make you feel safe enough to open the windows and balcony doors.

Sorry, I wasn't saying there had been burgalries where Oscar lived, just that I had read that there is a heightened perception of burgalry within the community - it might have meant the middle class community rather than Oscar's complex specifically. It was mentioned when Witness No.1 and her hubby immediately presumed that it was a burgalry and not a domestic violence situation. Might not have been mentioned in court, I might have read it elsewhere. My head is fried with this case.

I didn't take it that way Yogi  I understand there is a massive problem with crime in SA, I had already had a look about on the net about crimes in his complex and as far as I am aware it was a very safe gated community..that's not to say you still wouldn't be paranoid. 

I still think if you were that paranoid you would make sure your patio doors were locked before you went to sleep, but it seems on this complex they were quite comfortable and relaxed enough to sleep with the patio doors open.

Whoever said that today's witness, Darren Fresco, was tailoring his evidence to protect himself, was spot on. He was amending and omitting evidence and suffering from selective memory syndrome to suit his own agenda, imo.

Apparently he did not volunteer as a witness, he was obliged to appear. 

 

BBC Twitter guy noted that the state's non-expert witnesses have all seemed reluctant to admit any hint of ambiguity and asks, ' Coincidence or strategy?'.

Imo, that does not apply to the radiologist but does apply to the others.
