some of you might have read my thread about my neighbour dying and his wife asking me for advice

well, she has just been round to show me a letter she got from the pensions place and it reads, mrs ... we are sorry to here mr .... has died but any money that you have taken out of your joint post office a/c with need to be paid back Mad

the woman has just lost her husband Shake Head

her husband was claiming for the both of them and now he has died she has to make a new claim for herself, fair enough, he died on a sunday and her money was due on the monday, they have told her not to take the money out of the account causes its paid in advance and so its not hers, i always thought benefits was paid in arrears, so the money is hers, except maybe for the monday as he died on the sunday Confused

I don't think they can take it back out of the account once its been paid in though can they?

She may well need to pay some back but it'll probably take them a few weeks to sort out her payments so she may be better off taking the money to tide her over...anything she needs to pay back will be taken off weekly anyway if she pleads poverty.

If the woman in question is in receipt of Housing Benefit,Council Tax rebate,IS, then she should make application for Funeral Payment,see local Benefit office or CAB.

true, like croc as said they can't take it back out of the a/c, so i told her to take it as she hasn't any money

it is in advance Eeker well i've told her wrong then Frowner you don't get your wages in advance do you, so i always thought it worked the same way
When you get paid via the benefit agency the monies given are for the following week coming,not the week past.
