I made a ÂĢ250 cash payment (this was when the bailiffs came to my flat and took notes of my belonging without me knowing. They then gave me a payment plan of around ÂĢ140 a month which i thought was due to start 16/07/09. She rang today because the payment was due 30/06/09. So now its make full payment or we will take your stuff. Cant make full payment Frowner

let me be open with you here, it seems that you have let this go by and thinking all will be ok, your date for payment compared to their pamyent date are out by over 2 weeks, you must have had this in writting or letter of agreement to pay.

forget phoning them you need to go there in person and sort it out now

I don't mean to sound hateful but I wish my 3 kids had a taste/wake up call of what you're experiencing Kelly - mine thinks they're soooo hard done by Mad - my father left them ÂĢ40,000 each and they have good jobs too! They still think they're hard done by! Hubby and I are losing it with them tbh, even if I ask my daughter to pick up a pint of milk she takes the ,money and believe me our fridge/freezers.pantry and cupboards are so full, she's embarrassing tbh. The payment pay was confirmed in a txt. I would go back in my inbox and check but i deleted my inbox without thinking.

Kelly, their date was by the sounds of it correct and confirmed in a txt message and this message must have given the date you agreed to pay by

You need to contact them again and make a fresh offer to pay and stick to it or go down there and see tham face to face and explain

Ok.. without your signature and if the goods could reasonably have been listed from outside the premises then it could be difficult for the bailiff to prove they have been in your property. In order for it to be valid you have to allow them peaceful entry into the property: they can't just take an inventory from a window for example.

But they have been and so denying it leads you down a path of lying about it. That's for you to decide whether you want to do that.. I wouldn't necessarily recommend it and it doesn't solve your problem.

They still effectively have walking possession of your stuff. That means that the stuff listed has been seized by them and belongs to the bailiff and can be removed at any time. But they have allowed the stuff to stay in your home and for your use providing you keep your side of the agreement to pay.

Kelly you need to call the CAB asap and get an appointment with a debt counsellor. They will be able contact the bailiff and your creditors on your behalf. Take copies of everything to do with the debt with you and also a list of your income and outgoings.

Im not saying they are wrong but its an easy mistake to make. All my previous payments have been 16th of each month. I tried explaining this morning they were having none of it. I can continue making payments but until the full amount has been paid my stuff will still be taken.

I'm sure that others here will be able to better advise you on the bailliff/bankruptcy issues, but I just wanted to add that if they do take your things, you should be able to get some sort of replacements on freecycle. There are always loads of portable TV's and stuff on there. They won't be the latest models or they could have the remote missing or something, but if you're desperate, it's better than nothing hun.

Thank you tupps. I think if i were to lie at the end of the day i would still be fighting a losing battle and im sure they have experiance to tripping liers up.
Do you know if i can have the goods back after they have been taken if i make full payment?

Kelly I can't stress it enough!!!!

Go to CAB

They will draw up an income/expenditure plan ..IN YOUR FAVOUR ... and send it to your debtors with an amount you can repay. Once they have that they can't push for any more or contact you. SERIOUSLY ... I have a 20 grand debt that is being repayed at ÂĢ1 a month because of my financial position!!!! ... 3 months later and already they have contacted me with a settlement figure of 4 grand! wiping 16 grand off! Just wish I had the 4 grand to do it Crazy
