Pistorius's conviction appeal granted

  •

However, Judge Masipa dismissed the sentencing appeal of Oscar Pistorius, saying she did not believe the sentence was "shockingly inappropriate".

Judge Thokozile Masipa has granted the application by the state to appeal Oscar Pistorius's conviction, but has denied the application to appeal his sentence. (AFP)

Judge Thokozile Masipa has granted the state’s application to appeal paralympian athlete Oscar Pistorius’s conviction.

However, she dismissed the state’s application to appeal his sentence.

On Tuesday, Barry Roux SC for Pistorius told the court that the law had been correctly applied in the conviction and sentencing of the athlete.

Prosecutor Gerrie Nel argued that the sentence imposed on Pistorius was “shockingly inappropriate”.

Nel said the court showed too much mercy for Pistorius, who could have foreseen that he could unlawfully kill whoever was behind the door.

Sentencing On October 21, Masipa sentenced Pistorius to five years in jail for the culpable homicide of his girlfriend Reeva Steenkamp.

He shot her dead through the locked door of the toilet in his Pretoria home on February 14 last year, apparently thinking she was an intruder.

The state filed papers last month calling for a heavier conviction and harsher sentence to be imposed on the athlete. Pistorius was sentenced to a further three years, suspended for five years, for discharging a firearm at Tasha’s restaurant in Sandton, Johannesburg, in January 2013. – Sapa

Mandy Wiener       @MandyWiener                  Â·          1 hr     1 hour ago

Masipa says she is not convinced that sentence is shockingly inappropriate and application on sentence can't succeed.

looks like this will be going to the supreme court in Bloemfontain if the NPA can find the money but Eish!  knowing how SA is fixed these days what with load shedding can't see it happening

NPA says it must still think about whether or not it will petition SCA on sentence.

Mandy Wiener       @MandyWiener                  Â·          40 mins     40 minutes ago

Theoretically, there could be a situation that Oscar is out on correctional supervision while the appeal is being heard.

Mandy Wiener       @MandyWiener                      Â·          41 mins     41 minutes ago

Despite being ordered to pay costs on sentencing bid, the NPA will view this as a success. Can now appeal the conviction.

Mandy Wiener       @MandyWiener                  Â·          42 mins     42 minutes ago

A summary - The NPA can appeal Oscar's conviction but it cannot appeal his sentence. It can petition the SCA on sentence.

I think it for sure will be dealt with by the supreme court as I truly believe Masipa was out of her depth

Just been reading the other place...if they find him guilty of murder the sentence will automatically go to 15 years less time served..Nel could also ask the Supreme Court to look at the ammo and sentence charges, but a few seem to think he won't...

sometimes you have to lose a battle to win a war - he doesn't seem to be getting anywhere with the ammo charge so I think in the grand scheme of things he'd be wise to let that one drop and concentrate on the murder charge as for me, it's the most important

I hope they throw her findings out as well but with SA you never know and I'm sure OPs family while not paying Barry's bill, might bung a few rand to ensure he gets off on appeal

Oscar Pistorius will be released on probation by 21 August after a recommendation from South Africa's correctional services department.

The Olympic athlete was jailed for five years in 2014 for the culpable homicide of his girlfriend Reeva Steenkamp.

Under South African law he is eligible for release under "correctional supervision" having served a sixth of his sentence.

A state appeal against his acquittal on murder charges is due in November.

Oscar Pistorius will not be released from prison on Friday, the South African Justice Department has announced.

The Justice Minister has referred the decision to release Pistorius to a review panel, according to a report by eNCA,meaning his parole date had been suspended.

The Paralympian athlete was expected to be released from prison in Pretoria on Friday, where he would have carried out the rest of his sentence under house arrest at his uncle’s apartment. Pistorius was convicted of culpable homicide for shooting dead his girlfriend Reeva Steenkamp through a locked bathroom door on Valentine's Day in 2013.
