United Biscuits took the Customs & Excise to court some 20 years ago about whether Jaffa Cakes are biscuits or cakes. Chocolate coated biscuits are subject to VAT, but chocolate coated cakes aren't.

 

The judge decided that Jaffa cakes were cakes. United Biscuits said that if you leave cakes out, they go hard, but biscuits go soft, and the judge agreed.
