I know a little about ESA, what is the problem?

its for my daughter who has cerebal palsy. We put in a claim on friday....got a sick note today. Th doctor has backdated the sick note to july 08 due to her disability so I was wondering can she claim Incapaity benefit as her unfit for work period started before oct 08 when the esa rules started Confused

Here's your answer

A claim to Employment and Support Allowance can be backdated 3 months if there is supporting medical evidence. The Secretary of State will treat the claim as a claim for Incapacity Benefit or Income Support, as appropriate, if:

1. the backdating period spans 27 October 2008 and
2. the claim has been made on grounds of disability.

In these circumstances the existing backdating rules will apply.

From the DWP website.

ESA is turning into a right pain in the arse. I am an employment support officer helping people with learning disabilities into work, and this is right bloody nightmare.
